Please read these Terms of Service ("Terms") carefully before using followthefrequencies.com (the "Website"). By accessing or using our Website, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.

Follow the Frequencies ("FtF", "we", "us" or "our") is a creative label and studio based in Lisbon, Portugal, operating across sound design, creative direction, visual identity and curated products. The Website is operated by NAME.

2. Acceptance of Terms

By visiting, browsing or using any part of this Website — including placing an order, submitting a contact form or subscribing to our newsletter — you confirm that you are at least 16 years old and that you accept these Terms in full. If you are using the Website on behalf of a company or organisation, you confirm that you have the authority to bind that entity to these Terms.

3. Use of the Website

3.1 Permitted use
You may use this Website for lawful personal or professional purposes in accordance with these Terms. You may browse, read content, contact us and make purchases through our shop.

3.2 Prohibited use
You agree not to:

• Use the Website in any way that violates applicable local, national or international law or regulation

• Copy, reproduce, scrape or republish any content from this Website without our prior written permission

• Attempt to gain unauthorised access to any part of the Website or its underlying systems

4. Intellectual Property

4.1 Our content
All content on this Website — including text, images, graphics, audio, video, design, code, logos and visual identity — is the property of Follow the Frequencies or its licensors and is protected by applicable copyright, trademark and intellectual property law. You may not reproduce, distribute, modify or create derivative works from any content without our prior written consent.

4.2 Artist content
Content relating to artists represented on this Website (biographical information, photographs, music, recordings) is owned by the respective artists or their rights holders. Any use of such content beyond personal, non-commercial reference is strictly prohibited without the express written permission of the rights holder.

4.3 Limited licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website for personal or professional informational purposes only. This licence does not include the right to download, copy or modify any content for commercial use.

5. Shop — Products and Orders

5.1 Product descriptions
We make every effort to ensure that product descriptions, images and prices are accurate. However, we do not guarantee that all information is error-free. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.

5.2 Placing an order
By placing an order through our shop, you are making an offer to purchase a product. We reserve the right to accept or decline any order. A contract between you and FtF is formed only when we send you an order confirmation email.

5.3 Pricing and payment
All prices are displayed in Euros (€) and include applicable VAT where required by law. Payment is processed securely by Stripe or PayPal. FTF does not store your payment details. We accept credit and debit cards and PayPal.

5.4 Shipping
We currently ship physical products within Europe. Delivery times and shipping costs are displayed at checkout. We are not responsible for delays caused by customs, postal services or circumstances beyond our control. Risk of loss and title for physical products pass to you upon delivery.

5.5 Digital products
Digital products (such as sample packs, downloadable files or digital prints) are delivered electronically. Once a digital product has been downloaded, it cannot be refunded unless it is defective.

5.6 Order cancellation
You may cancel a physical product order within 24 hours of placing it, provided it has not yet been dispatched. To cancel, please contact us at marta@followthefrequencies.com.

6. Returns and Refunds

6.1 Right of withdrawal (EU consumers)
If you are a consumer based in the European Union, you have the right to withdraw from a purchase of physical goods within 14 calendar days of receiving your order, without giving a reason, in accordance with EU Directive 2011/83/EU. To exercise this right, please notify us in writing at marta@followthefrequencies.com before the 14-day period expires.

6.2 Conditions for returns
To be eligible for a return, items must be:

• Unused and in their original condition

• Returned in original packaging

• Accompanied by proof of purchase

Return shipping costs are the responsibility of the customer, unless the item is defective or incorrect.

6.3 Refunds
Once we receive and inspect the returned item, we will notify you by email. If approved, your refund will be processed to your original payment method within 14 days.

6.4 Defective or incorrect items
If you receive a defective or incorrect item, please contact us within 7 days of delivery at marta@followthefrequencies.com. We will offer a replacement or full refund at no additional cost to you.

6.5 Digital products
Due to the nature of digital goods, purchases of digital products are non-refundable once downloaded, except where the product is defective or materially different from its description.

6.6 Services
Payments for creative services (such as direction, design or consulting) are governed by the individual service agreement signed between FtF and the client, which takes precedence over these Terms.

7. Services

FTF offers creative services including sound design, visual identity, creative direction and consulting. Engagements for these services are governed by a separate written agreement (contract or proposal) agreed between FTF and the client. In the absence of such an agreement, these Terms apply by default.

8. Newsletter and Communications

By subscribing to our newsletter, you consent to receiving email communications from FtF about our work, releases, products and updates. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us directly. We use Mailchimp to manage our mailing list. Your data will be handled in accordance with our Privacy Policy.

9. Third-Party Links and Services

Our Website may contain links to third-party websites, platforms or services (such as Spotify, social media, or partner websites). These links are provided for convenience only. FtF has no control over the content or practices of third-party websites and accepts no responsibility for them. Visiting a third-party website is entirely at your own risk.

10. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, FtF disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose and non-infringement

• That the Website will be uninterrupted, error-free or free of viruses or other harmful components

• That any content on the Website is accurate, complete or up to date

11. Limitation of Liability

To the fullest extent permitted by applicable law, FtF shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Website or our services, including but not limited to loss of profits, data, goodwill or other intangible losses.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Website shall not exceed the amount you paid to FTF in the 12 months prior to the event giving rise to the claim, or €100 (whichever is greater).

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.

12. Privacy

Your use of this Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

13. Changes to the Website and These Terms

We reserve the right to modify, suspend or discontinue any part of the Website at any time without notice. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Website after any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence, in accordance with applicable EU consumer protection law.

Alternative Dispute Resolution (ADR)
In accordance with EU Regulation No. 524/2013, EU consumers may also submit disputes to the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr

15. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. If modification is not possible, it shall be severed from the Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any separate service agreement, constitute the entire agreement between you and FtF regarding your use of the Website and supersede all prior agreements, representations and understandings.
